Terms of Service

1. Acceptance of Terms

By accessing or using Netstats (“the Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please refrain from using the Site.

2. Description of Service

Netstats provides a tool to detect and display internet outages across public terrestrial internet networks (such as fiber, cable, and DSL) from our system's vantage point. Our platform is currently free to use and is supported by advertisements. Netstats results represent detected disruptions as observed by our detection tools and are not definitive indicators of a network’s overall reliability. Outage detection may be limited by certain factors and should not be used as a sole measure of service quality.

3. User Responsibilities

Netstats is accessible to the public without requiring user accounts or login. Users are responsible for ensuring that their use of the Site complies with these Terms and all applicable laws.

4. Prohibited Uses

Users are only permitted to access the data on Netstats directly through the Site via a standard web browser or official mobile application. Accessing or attempting to access the Site’s data through any automated means, scripts, scraping, or similar techniques violates these Terms. Additionally, redistributing, reproducing, or publishing any data from Netstats without express written permission is strictly prohibited.

5. Intellectual Property

All content, design elements, features, data, and branding on Netstats are the exclusive property of Netstats and are protected by applicable copyright, trademark, and other intellectual property laws. Users may not copy, distribute, modify, or otherwise use any of Netstats' intellectual property without prior written consent.

6. Data Collection & Privacy

Netstats may collect certain information, such as IP addresses, general location data, and usage patterns, to improve and operate the Site. By using the Site, you consent to this data collection as outlined in our Privacy Policy. Netstats is committed to protecting user data and will not sell or share personal information with third parties, except as necessary to operate the Site or as required by law.

7. Disclaimer of Warranties

Netstats is provided on an "as-is" and "as-available" basis. We make no guarantees regarding the accuracy, completeness, reliability, or availability of the Site or the data displayed. Netstats does not warrant that the Site will be error-free or uninterrupted. Outage data is collected using automated tools and may not always accurately reflect real-time conditions or cover all potential disruptions.

8. Limitation of Liability

To the maximum extent permitted by law, Netstats and its affiliates, employees, and partners shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the Site, even if we have been advised of the possibility of such damages. This includes, but is not limited to, damages arising from errors, inaccuracies, or omissions in the data or information provided on the Site.

9. Termination

Netstats reserves the right to suspend or terminate access to the Site, without prior notice or liability, for any conduct that we believe violates these Terms or is harmful to other users or to Netstats. Upon termination, your right to use the Site will immediately cease, and any restrictions or protections provided by these Terms will remain in effect.

10. Geographic Limitation and International Use

Netstats is operated by a Canadian corporation and is governed by Canadian law. While the Site is accessible globally, Netstats does not guarantee that the Site or its content is appropriate or available for use in all locations. Users accessing Netstats from outside of Canada do so at their own risk and are responsible for compliance with their local laws.

11. Third-Party Links

Netstats may contain links to third-party websites or resources. These links are provided for convenience only, and Netstats does not endorse or assume responsibility for any third-party sites, content, products, or services. Access to third-party websites is at the user’s own risk.

12. Indemnification

By using the Site, you agree to indemnify, defend, and hold harmless Netstats, its affiliates, employees, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your use of the Site or any violation of these Terms.

13. Force Majeure

Netstats shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of government, network outages, or other similar events.

14. Changes to the Terms

Netstats reserves the right to update or modify these Terms at any time without prior notice. Any changes to the Terms will be effective immediately upon posting to the Site. Continued use of the Site after any such changes constitutes your acceptance of the revised Terms. We encourage users to review these Terms periodically for any updates.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or your use of Netstats shall be resolved in the courts located within Canada.
